Diese Nutzungsbedingungen („EULA", „Vereinbarung") regeln die Nutzung der mobilen Anwendung KONG — Maskulin Zuckerfrei („KONG", „die App"), bereitgestellt von Nocta Dev, LLC („wir", „uns"). Durch den Download oder die Nutzung der App stimmst du diesen Bedingungen zu.
Wir gewähren dir eine widerrufliche, nicht übertragbare, nicht exklusive Lizenz zur Nutzung der App auf einem Apple-Gerät, das du besitzt oder kontrollierst, ausschließlich für den persönlichen, nicht kommerziellen Gebrauch und gemäß den App Store-Nutzungsregeln von Apple.
KONG ist ein digitales Hilfsmittel zur Gewohnheitsveränderung. Die App dient dazu, dir dabei zu helfen, einen zuckerfreien Lebensstil zu verfolgen, indem sie Streaks, tägliche Check-ins und Motivationshilfen bereitstellt.
KONG ist kein medizinisches Produkt und ersetzt keine ärztliche oder ernährungswissenschaftliche Beratung. Vor wesentlichen Veränderungen deiner Ernährung solltest du einen Arzt oder eine qualifizierte Fachperson konsultieren, insbesondere bei gesundheitlichen Vorerkrankungen.
KONG bietet folgende kostenpflichtige Angebote an:
Abonnements verlängern sich automatisch, sofern die automatische Verlängerung nicht mindestens 24 Stunden vor Ende des aktuellen Zeitraums deaktiviert wird. Die Verlängerungskosten werden innerhalb von 24 Stunden vor Ende des aktuellen Zeitraums in Rechnung gestellt, zum jeweils ausgewiesenen Preis.
Die Zahlung wird bei Kaufbestätigung über dein Apple-ID-Konto abgerechnet. Abonnements können jederzeit verwaltet und die automatische Verlängerung kann in deinen Apple-ID-Kontoeinstellungen nach dem Kauf deaktiviert werden.
Ein laufender Abonnementzeitraum kann während seiner Laufzeit nicht gekündigt werden. Du kannst dein Abonnement jedoch jederzeit deaktivieren, sodass es sich nicht automatisch verlängert.

Der Lifetime-Zugang ist eine einmalige Zahlung und kein Abonnement. Er verlängert sich nicht automatisch. „Lifetime" bezieht sich auf die Lebenszeit der App KONG, nicht auf die natürliche Lebenszeit des Nutzers.
Du verpflichtest dich, die App nicht zu:
Alle Rechte an der App, einschließlich Design, Code, Grafiken (einschließlich des Gorilla-Maskottchens) und Inhalte, liegen bei Nocta Dev, LLC oder ihren Lizenzgebern.

Die App wird „wie besehen" und „wie verfügbar" bereitgestellt. Wir garantieren nicht, dass die App fehlerfrei, ununterbrochen verfügbar oder für einen bestimmten Zweck geeignet ist. Soweit gesetzlich zulässig, schließen wir alle stillschweigenden Gewährleistungen aus.
Soweit gesetzlich zulässig, haftet Nocta Dev, LLC nicht für indirekte, zufällige oder Folgeschäden, die sich aus der Nutzung oder Nichtnutzung der App ergeben. Unsere Gesamthaftung ist auf den Betrag beschränkt, den du für die App in den letzten 12 Monaten gezahlt hast.
Diese Lizenz endet automatisch, wenn du gegen eine der Bestimmungen dieser EULA verstößt. Du kannst die Lizenz jederzeit durch Deinstallation der App beenden.
Diese EULA wird zwischen dir und Nocta Dev, LLC geschlossen, nicht mit Apple. Apple ist nicht für die App oder deren Inhalte verantwortlich. Im Falle eines Mangels hast du Anspruch auf Erstattung des Kaufpreises (sofern zutreffend) durch Apple; darüber hinausgehende Ansprüche gegen Apple sind ausgeschlossen. Apple und seine Tochtergesellschaften sind Drittbegünstigte dieser EULA und berechtigt, diese Bedingungen gegenüber dir durchzusetzen.
Diese EULA unterliegt dem Recht des US-Bundesstaates, in dem Nocta Dev, LLC registriert ist, unter Ausschluss seiner Kollisionsnormen. Verbraucher innerhalb der Europäischen Union genießen zusätzlich den Schutz der zwingenden Verbraucherschutzbestimmungen des Landes, in dem sie ihren gewöhnlichen Aufenthalt haben.
Wir können diese EULA von Zeit zu Zeit aktualisieren. Die aktuelle Fassung ist stets auf dieser Seite verfügbar.

These Terms of Use ("EULA", "Agreement") govern your use of the mobile application KONG — Maskulin Zuckerfrei ("KONG", "the App"), provided by Nocta Dev, LLC ("we", "us"). By downloading or using the App, you agree to these terms.
We grant you a revocable, non-transferable, non-exclusive license to use the App on an Apple-branded device that you own or control, for personal, non-commercial use only, and subject to Apple's App Store Terms of Service.
KONG is a digital habit-change tool. The App is designed to help you pursue a sugar-free lifestyle by providing streak tracking, daily check-ins, and motivational tools.
KONG is not a medical product and does not replace medical or nutritional advice. You should consult a physician or qualified professional before making significant changes to your diet, particularly if you have any pre-existing health conditions.
KONG offers the following paid options:
Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price listed.
Payment will be charged to your Apple ID account upon confirmation of purchase. Subscriptions can be managed, and auto-renewal may be turned off, in your Apple ID account settings after purchase.
You cannot cancel an active subscription period during that period. You can, however, disable your subscription at any time so that it does not automatically renew.

Lifetime access is a one-time payment, not a subscription. It does not auto-renew. "Lifetime" refers to the lifetime of the KONG app, not the natural lifetime of the user.
You agree not to:
All rights in the App, including design, code, graphics (including the gorilla mascot), and content, belong to Nocta Dev, LLC or its licensors.

The App is provided "as is" and "as available". We do not warrant that the App will be error-free, uninterrupted, or fit for a particular purpose. To the extent permitted by law, we disclaim all implied warranties.
To the extent permitted by law, Nocta Dev, LLC is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the App. Our total liability is limited to the amount you have paid for the App in the past 12 months.
This license terminates automatically if you violate any provision of this EULA. You may terminate the license at any time by uninstalling the App.
This EULA is between you and Nocta Dev, LLC, not with Apple. Apple is not responsible for the App or its content. In the event of a defect, you are entitled to a refund of the purchase price (if applicable) from Apple; any further claims against Apple are excluded. Apple and its subsidiaries are third-party beneficiaries of this EULA and are entitled to enforce these terms against you.
This EULA is governed by the laws of the U.S. state in which Nocta Dev, LLC is registered, excluding its conflict-of-laws provisions. Consumers within the European Union additionally enjoy the protection of the mandatory consumer-protection provisions of their country of habitual residence.
